RPS 211 (Regulatory Position Statement)

Paul Downing

Regulatory Position Statement 211 (RPS 211). This states that utilities companies who excavate waste after the end of April 2019 must consider their waste hazardous. There is therefore the requirement to transfer waste to a permitted site. Alternatively you can apply for a SR2010 No12 permit to treat the waste yourselves.

We have worked with several utility companies to also help them apply for SR 2010 No12 or a bespoke permit from the Environment Agency if required.

We can help you decide how to comply with RPS 211 and how best to go about a permit application. Call us for more information on 01428 768 087.

Update – April 2025 – This guidance was withdrawn on 4 June 2024

This regulatory position statement has been replaced by:

Classify excavated waste from street and utility works: RPS 298

Storing and managing excavated waste from street works: RPS 299

Both of these new regulatory position statements will help you classify and give guidance on excavated wastes from street works. Such as those working on installing cables and telephone lines near residential housing. Should you need more help on this topic or need clarification on the terms used. Please call us for an initial discussion. Paul Downing & Associates Ltd.
