Regulation 61 notices issued by the Environment Agency are not to be ignored.

Under the Environmental Permitting Regulations the Environment Agency can issue a request for information on your permitted activity. For example the EA have recently issued Regulation 61 notices for the food and drink industry. It related to BAT (Best Avaialble Techniques). A recent Regulation 61 Notice has also been issued to identified operators. This is asking them how they plan to conduct a climate change risk assessment.

Receiving such a notice means that you are required by law to provide the information requested. Failure to do so could face you with enforcement action or a fine.

The Environment Agency tend to send out these Regulation 61 notices en mass. To certain types of industries at a time.

So therefore if they are focusing on reviewing the permit conditions of the chemical industry for example. Certain sectors in the chemical industry will receive these notices at the same time.

Most of the time the notice is quite straight forward to comply with. However in some instances you may need to spend quite a bit of time in getting the required information together.
